Partner sponsored applicants are assessed on an individual basis depending on the nature of their relationship. The Australia partner visa enables the partner or spouse of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen to reside in Australia for an extended period. Spouse Visa Subclass 820/801– Both partners must have turned 18 and the marriage must be legal under Australian law. Underage or polygamous marriages are not accepted in Australia.

To be eligible to apply for a Spouse visa, the applicant must be either married to:

  1. an Australian citizen; or
  2. an Australian permanent resident; or
  3. an eligible New Zealand citizen.

De-facto Partner Visa Subclass 820/801 – the de facto relationship must have existed for at least 12 months before applying for the visa

  1. Live together (You and your partner must be living together, or any separation must be only temporary not on a permanent basis)
  2. Commitment to a shared life to exclusion of all others (a genuine and continuing relationship with your partner)
  3. Must have lived together for a period of at least 12 months prior to lodging visa application.

Prospective Marriage Visa Subclass 300 

 

This visa enables to enter Australia to marry your intended spouse and live together in Australia. You can apply for a Spouse visa in Australia after you marry your fiance(é)

A Prospective Marriage visa is a temporary visa valid for nine months. Once granted, within the 9 months the applicant must register their marriage.

Eligibility criteria for Prospective Marriage Visa

  1. Applicant must be sponsored by their fiance(e) who must be at least 18 years of age
  2. Must be sponsored by an Australian citizen or permanent resident, or an eligible New Zealand citizen, who undertakes sponsorship obligations.
  3. Must have personally known and physically met their fiance(e), must not marry prior to entering Australia.
  4. Applicants must agree to marry within 9 months of entering Australia.
  5. Must not have any impediment to marrying under Australian Law

This visa allows the applicant to live, work and study in Australia for 9 months. You are also permitted to travel freely to and from Australia during this period.

Transit visa (subclass 771)  This visa is for passengers who

  • transit through Australia for no longer than 72 hours
  • enter Australia by air before joining the crew of a non-military ship as a Maritime Crew visa (subclass 988) holder

Applicant must

  • be outside Australia and have a confirmed booking to travel to another country within 72 hours of arriving in Australia and the correct documents to enter that country
  • if you are joining the crew of a non-military ship, be outside Australia and hold a Maritime Crew visa and the necessary crew documents

 

 Visitor (subclass 600) – This visa does provide work rights in Australia.

You must also meet the following eligibility requirements:

Business Visitor (subclass 600) visa  is suitable for those wishing to attend conferences, negotiate business, short term project (less than 6 weeks), training sessions or make an exploratory business visit. This visa is available to all passport holders who want to visit Australia for business purposes. No sponsorship is required.

Work and Holiday visa (subclass 462)

Work and Holiday 462 Visa is for people between 18 and 30 years of age from reciprocating countries to holiday in Australia and work for a short-term.

Working Holiday 417 visa is valid for 12 months from the date of first entry and holders are permitted to travel freely to and from Australia during this period. They are permitted to work for up to 6 months with each employer and undertake up to 4 months of study or training.
